Terms and Conditions

1. Promotion Period

This promotion commences at 12:00am AEST on 18 September 2025 and closes at 11:59pm AEST on 15 November 2025 ("Promotion Period").

This promotion is open to Australian citizens and permanent residents only.

2. Eligibility

2.1 Player Eligibility

To be eligible to enter this promotion, players must:

• Be Australian citizens or permanent residents
• Be 18 years of age or older at the time of registration
• Play for a registered cricket club in Australia
• Register your interest on www.cricketerexchange.com during the Promotion Period
• Express interest in cricket opportunities in the UK for 2026
• Entry is free. Standard internet and data charges may apply.

2.2 Club Eligibility

Eligible clubs must:

• Be registered on Play Cricket Australia
• Be affiliated with an organised cricket association (state or local level)
• Not be part of purely social or recreational leagues
• Be verifiable through the Play Cricket Australia database

This promotion is open to eligible cricket clubs in all Australian states and territories, unless prohibited by law.

2.3 Exclusions

The following persons are not eligible to enter:

• Employees of Sports Recruits Pty Ltd and their immediate family members
• Directors and shareholders of Sports Recruits Pty Ltd and their immediate family members
• Players from cricket clubs where the Promoter has a current business relationship or involvement
• Any person who has been previously disqualified from Cricketer Exchange promotions

3. Entry Method

3.1 How to Enter

To enter this promotion, eligible players must:

• Visit www.cricketerexchange.com during the Promotion Period
• Complete the specific PROMOTION ENTRY FORM (not general website registration)
• This promotion entry form is separate from standard website registration
• Complete the promotion entry form including:
  • Full name and contact details
  • Current cricket club name
  • Playing level and position details
  • Confirmation of interest in UK cricket opportunities for 2026
• Accept these Terms and Conditions
• Opt-in to receive marketing communications (consent is voluntary and can be withdrawn at any time without affecting eligibility for the promotion)
• Submit the completed registration

3.2 Entry Limitations

• Only one (1) entry per person is permitted
• Each eligible player registration constitutes one (1) entry for their nominated cricket club
• Multiple registrations by the same person will result in disqualification
• Incomplete registrations will not be accepted
• Each player registered counts for an entry for their club

3.3 Club Verification

• All club registrations will be verified against the Play Cricket Australia database
• Only players from verified eligible clubs will be included in the draw
• The Promoter reserves the right to request additional verification documentation
• Clubs that cannot be verified will be excluded from the promotion

3.4 Information Accuracy

• All information provided must be complete, accurate, and truthful
• Entries containing incorrect, incomplete, false, or misleading information may be deemed invalid
• The Promoter reserves the right to request correction of minor errors at its discretion
• Failure to provide accurate information may result in disqualification

4. Prize Details

4.1 Prize Description

There is one (1) prize available:

• The winning club must provide a tax invoice to Sports Recruits Pty Ltd
• Payment will be made within thirty (30) business days of receiving a valid invoice
• Invoice must include the club's legal name, ABN (if applicable), and contact details
• Prize payment will be made via electronic funds transfer

5. Draw Details

5.1 Draw Method

• One (1) random draw will be conducted on 20 November 2025
• Draw will be conducted using a certified random number generator
• Each verified player entry represents one (1) chance for their nominated club to win
• Clubs with more verified player entries have proportionally higher chances of winning

5.2 Draw Supervision

• Draw will be conducted at the Promoter's premises
• Independent verification of the draw process will be maintained
• Draw results will be recorded and retained for audit purposes

6. Winner Notification and Publication

6.1 Winner Contact

• The winning player will be contacted within two (2) business days of the draw
• Contact will be made using the details provided during registration
• Winner must respond within seven (7) days to claim the prize on behalf of their club
• If no response is received, a redraw will be conducted

6.2 Publication

• Winner announcement will be published on www.cricketerexchange.com
• Announcement may also be made via Cricketer Exchange social media channels
• By entering, participants consent to the use of their name, club name, and general location for publicity purposes in any media without additional compensation, unless prohibited by law

7. Prize Conditions

7.1 Prize Acceptance

• Prizes are not transferable, exchangeable, or redeemable for cash
• Prizes must be claimed by the nominated cricket club only
• The Promoter reserves the right to substitute prizes of equivalent value
• Prize value includes any applicable taxes

7.2 Unclaimed Prizes

• Unclaimed prizes may be re-drawn at the Promoter's discretion
• Unclaimed prizes will not be awarded if no valid claim is made within 60 days

8. Privacy and Data Use

8.1 Collection and Use

• Personal information collected will be used for promotion administration
• Information will be used for marketing communications if consent is provided
• Data may be shared with third parties for prize fulfilment
• Information handling complies with the Privacy Act 1988 (Cth)

8.2 Marketing Consent

• Entrants may opt-in to receive marketing communications from the Promoter
• Consent is voluntary and can be withdrawn at any time without affecting promotion eligibility

9. General Conditions

9.1 Verification

• The Promoter reserves the right to verify all entries and eligibility

• The Promoter's decision on eligibility is final

9.2 Disqualification

The Promoter may disqualify entries that:

• Do not comply with these Terms and Conditions
• Are deemed inappropriate, offensive, or unlawful
• Are submitted using automated or bulk entry methods
• Cannot be verified or contain false information
• Where the Promoter reasonably suspects any form of fraud, tampering, or manipulation of the entry process

9.3 Technical Issues

• The Promoter is not responsible for technical failures
• Lost, delayed, or corrupted entries due to technical issues may not be accepted
• Website maintenance or downtime does not extend the Promotion Period
• Alternative entry methods may be provided at the Promoter's discretion

10. Liability and Disclaimers

10.1 Limitation of Liability

To the maximum extent permitted by law:

• The Promoter excludes all warranties and representations
• Liability is limited to re-conducting the promotion or awarding substitute prizes
• The Promoter is not liable for indirect, special, or consequential damages
• Total liability does not exceed the total prize value
• Nothing in these Terms and Conditions limits, excludes, or modifies the statutory consumer guarantees provided under the Australian Consumer Law

10.2 Force Majeure

The Promoter is not liable for delays or failures due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions, epidemics, pandemics, public health orders, or technical failures.

11. Compliance and Permits

11.1 Trade Promotion Compliance

This promotion is conducted in accordance with:

• Competition and Consumer Act 2010 (Cth)
• Australian Consumer Law
• Applicable state and territory trade promotion legislation

11.2 Responsible Gaming

12. Disputes and Governing Law

12.1 Dispute Resolution

• All disputes must be raised within thirty (30) days of the draw date (20 November 2025)

• Unresolved disputes may be referred to relevant consumer protection agencies
• The Promoter's decision on all matters is final

12.2 Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. Participants submit to the exclusive jurisdiction of Victorian courts.

13. Amendment and Termination

13.1 Right to Amend

The Promoter reserves the right to:

• Modify these Terms and Conditions with reasonable notice
• Cancel or suspend the promotion due to technical or legal issues
• Substitute prizes of equivalent or greater value
